释义	法律分析: 嫖娼是违法行为，不是犯罪行为。因此，如果嫖娼被抓了，就会受到治安处罚，治安处罚会有记录，但处罚记录不记入人事档案。公安机关对卖淫嫖娼人员的处罚，必须与违法行为的事实和社会危害程度相适应，严禁以罚款、劳动教养、收容教育、行政拘留代替处罚。法律依据: 《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
