释义	刑法规定的扒窃乃盗窃罪的一种。所谓扒窃行为，一般具备两个特征：一是窃取行为发生在公共场所，通常发生在公共交通工具、车站、码头、民用航空站、市场、商场、公园、广场等公用建筑及公用场所设施；二是秘密窃取的对象通常为被害人贴身放置的财物，如餐厅顾客放在座位上的包袋内财物，或是挂在座位椅背上的衣服口袋内的财物。如果行为人趁顾客短暂离开座位时行窃，或是窃取乘客放在公共交通工具行李架上等非贴身位置的财物，一般可认定为普通盗窃行为。
