军人能可不可以现役军人离婚
释义
军人能与现役军人离婚，法律并没有规定现役军人不得离婚，而且如果双方都是现役军人的，离婚时不需要经过彼此的同意即可提起离婚诉讼。
如果是现役军人与非军人离婚的，在军人一方不存在重大过错的情况系还需要经过军人一方同意，否则不准离婚。
【法律依据】
《民法典》第一千零八十一条，现役军人的配偶要求离婚，应当征得军人同意，但是军人一方有重大过错的除外。
