释义	法律分析：当事人对自己提出的仲裁请求的事实依据，有责任提供证据加以证明。对劳动合同是否履行发生争议的，由负有履行义务的当事人承担举证责任。也就是说，如果在履行劳动合同期间，员工被单位解除了合同，员工对此不服时，必须拿出合同仍然成立和生效的证据，而用人单位则要拿出解雇员工的证据。法律依据：《中华人民共和国劳动争议调解仲裁法》第六条发生劳动争议，当事人对自己提出的主张，有责任提供证据。与争议事项有关的证据属于用人单位掌握管理的，用人单位应当提供人单位不提供的，应当承担不利后果。
