释义	法律分析：如果宅基地申请下来后，超两年以上没建房，宅基地可由集体收回。也就是说，如果宅基地空闲了两年以上，可能要重新申请宅基地，经批准后再建，否则就可能算违建。法律依据：《确定土地所有权和使用权的若干规定》第二十九条因原房屋拆除、改建或自然坍塌等原因，已经变更了实际土地使用者的，经依法审核批准，可将土地使用权确定给实际土地使用者。空地及房屋坍塌或拆除后两年以上仍未恢复使用的土地，由当地县级以上人民政府收回土地使用权。
