释义	强制制拆迁拟全部由法院作出裁决，行政部门不再决定是否强拆，如果拆迁人不按照协议搬迁，需要通过法院进行裁决，然后决定是否可以进行强制执行处理，行政机关无权擅自强制拆迁。法律依据《国有土地上房屋征收与补偿条例》第二十八条被征收人在法定期限内不申请行政复议或者不提起行政诉讼，在补偿决定规定的期限内又不搬迁的，由作出房屋征收决定的市、县级人民政府依法申请人民法院强制执行。
