释义	违约方不享有合同解除权。但是在有些情况下，如果继续履行合同，违约方将面临更大的损失，而守约方拒不行使解除权。那么法院应当根据违约方的请求判决解除合同。同时，守约方有权要求违约方赔偿损失。我国现行法律并没有关于违约方不得解除合同的明确规定。在一方不愿意继续履行合同时，虽然有强制履行的制度设定，但强制履行显然不可能适用于所有不自愿履行的情形。
