释义	法律分析：借名买房协议是合法有效的，但是借名买房需要承担一定的法律风险，也就是说借名买房属于是合法有效的合同，但是又因为不动产权属证书是记名的，所以说不转移登记之前，实际记名人是有可能对房子进行处置的，法定情形下，第三人可以取得房子的所有权。法律依据：《关于审理房屋买卖合同纠纷案件适用法律若干问题的指导意见（试行）》第十五条当事人约定一方以他人名义购买房屋，并将房屋登记在他人名下，借名人实际享有房屋权益，借名人依据合同约定要求登记人（出名人）办理房屋所有权转移登记的，可予支持。
