释义	我国《农村土地承包法》对土地承包经营权的继承采取了两种不同的规定：对于家庭承包，只有林地承包人死亡，其继承人才可以在承包期内继续承包；耕地或草地等农用地上的土地承包经营权不能继承，若承包期内家庭成员全部死亡，土地承包经营权消灭，由发包方收回承包地。法律依据：《农村土地承包法》第三十二条承包人应得的承包收益，依照继承法的规定继承。林地承包的承包人死亡，其继承人可以在承包期内继续承包。
