释义	法律分析：应当正确区分医疗事故责任罪与就诊人或其亲属造成的事故。在有些情况下，就诊人的死亡或者其他严重后果，并非医务人员的行为所致，而是由于就诊人或者其家属不配合治疗或者擅自采用其他药物治疗等造成的。对此，不能认定为医疗责任事故罪。法律依据：《医疗事故处理办法》第五条医疗事故分为责任事故和技术事故。责任事故是指医务人员因违反规章制度、诊疗护理常规等失职行为所致的事故;技术事故是指医务人员因技术过失所致的事故。
