有帮助义务。在我国夫妻财产实行法定财产制与约定财产制相结合的原则，二者之间的适用原则是“有约定从约定，无约定从法定”。约定财产制具有优先于法定财产制的效力，没有约定或约定不明确的才适用法定财产制。

《中华人民共和国民法典》 第一千零九十条 离婚时，如果一方生活困难，有负担能力的另一方应当给予适当帮助。具体办法由双方协议议不成的，由人民法院判决。
