释义	法律分析：先诉抗辩权，就其性质而言，它是一种延期的抗辩权。先诉抗辩权行使的结果，是暂时的延续债权人请求权的行使，而并不是消灭其请求权。先诉抗辩权是指一般保证的保证人在主债权人向其请求履行保证责任时，有权要求主债权人先就债务人财产诉请强制执行；在主合同债权债务纠纷未经审判或仲裁，并就主债务人财产依法强制执行仍不能履行债务前，保证人可以对主债权人拒绝承担保证责任的特殊抗辩权。法律依据：
