释义	法律分析：定金是指为担保合同债权的实现，双方当事人通过书面约定，由一方当事人向对方预先支付一定数额的金钱作为担保的方式。付定金的一方不履行约定的债务的，无权要求返还定金;收受定金的一方不履行约定的债务的，应当双倍返还定金。定金的数额由当事人约定，但不得超过主合同标的额的百分之二十。法律依据：《中华人民共和国劳动合同法》第八十七条用人单位违法解除劳动合同的，应当按照解除劳动合同经济补偿金标准的二倍向劳动者支付赔偿金。
