员工想要离职,用人单位不同意应该怎么办
释义
法律分析:员工辞职,是通知用人单位,而不是向用人单位“申请”辞职。所以,凡是员工辞职的,只要履行了提前预告义务,预告期满后,除双方协商一致外,用人单位不得以任何理由强行留下员工继续工作。同时,在预告期内,双方都有继续履行劳动合同的义务,任何一方在未得到对方同意的情况下都不得提前或延后解除劳动合同。
法律依据:《劳动合同法》第三十七条规定,劳动者提前三十日以书面形式通知用人单位,可以解除劳动合同。劳动者在试用期内提前三日通知用人单位,可以解除劳动合同。
