释义	法律分析：通常情况下，如果是开发商破产的话，一般是不会坐牢的。公司申请破产法定代表人不会坐牢的。但是如果公司经营过程中存在违反《公司法》规定的行为，如虚假出资，抽逃出资，虚报注册资本、偷税逃税等行为的，情节严重的，需要依法追究其刑事责任。法律依据：《公司法》第一百八十七条清算组在清理公司财产、编制资产负债表和财产清单后，发现公司财产不足清偿债务的，应当依法向人民法院申请宣告破产。公司经人民法院裁定宣告破产后，清算组应当将清算事务移交给人民法院。
