释义	法律分析：本村村民集体所有的土地，租给外村人经营的，必须首先经村民会议三分之二以上成员或三分之二以上村民代表同意，否则租赁合同无效;若土地管理者违背村民共同意志将集体所有土地租给外村人，本村半数以上村民向法院提起诉讼的，法院应予以受理。法律依据：《中华人民共和国农村土地承包法》第三条国家实行农村土地承包经营制度。农村土地承包采取农村集体经济组织内部的家庭承包方式，不宜采取家庭承包方式的荒山、荒沟、荒丘、荒滩等农村土地，可以采取招标、拍卖、公开协商等方式承包。
