释义	法律分析: 没有签订劳动合同，单位没有缴纳社会保险。你应收集存在劳动关在系的证据，到当地劳动局申请劳动仲裁，要求公司支付经济补偿金。还可以要求支付双倍工资及补缴社会保险劳动保险金。单位违规辞退的也需要承担相应的赔偿金。法律依据: 《中华人民共和国劳动合同法》第四十七条经济补偿的计算经济补偿按劳动者在本单位工作的年限，每满一年支付一个月工资的标准向劳动者支付。六个月以上不满一年的，按一年计算;不满六个月的，向劳动者支付半个月工资的经济补偿。
