释义	武器装备肇事罪是军人违反武器装备使用、管理规定而发生重大责任事故，致人重伤、死亡或者造成其他严重后果的行为。按中国刑法属于违反军人职责罪。犯罪主体必须是军人或军内在编职工，其他人员不构成本罪。《刑法》第四百三十六条违反武器装备使用规定，情节严重，因而发生依责任事故，致人重伤、死亡或者造成其他严重后果的，处三年以下有期徒刑或者拘役；后果特别严重的，处三年以上七年以下有期徒刑。法律依据《中华人民共和国刑法》第四百三十六条
