释义	法律分析: 承包方违约转包的，依法由建设行政主管部门或其他有关部门责令改正，没收违法所得并处罚款，可以责令停业整顿、降低资质等级，情节严重的吊销资质证书。我国法律明令禁止承包人在承包工程后将其承包的工程建设任务转让给第三人，转让人退出承包关系，受让人成为承包合同的另一方当事人的行为。《中华人民共和国建筑法》第二十八条禁止承包单位将其承包的全部建筑工程转包给他人，禁止承包单位将其承包的全部建筑工程肢解以后以分包的名义分别转包给他人。
