释义	购房首付，房贷还没下来，能否办理以下几种情况：1、如果房贷合同因开发商原因未签订，买方可以不负任何责任办理退房手续，甚至要求开发商承担责任；2、如果贷款不能办理，因为不属于开发商和买方，买方也可以要求终止合同并返还首付款；3、如果是由于买方自身原因，如买方提供的信息不完整或购房者无力偿还，法院一般不予支持。法律依据：《中华人民共和国民法典》第四百六十五条依法成立的合同，受法律保护。依法成立的合同，仅对当事人具有法律约束力，但是法律另有规定的除外。
