释义	法律分析：承诺的效力是合同订立的前提。承诺的生效导致合同成立。合同成立，承诺归于消灭。明示的承诺于承诺通知到达要约人时生效，默示的承诺于推定行为到达要约人时生效。法律依据：《中华人民共和国民法典》第四百八十三条，承诺生效时合同成立，但是法律另有规定或者当事人另有约定的除外。《中华人民共和国民法典》第四百八十四条，以通知方式作出的承诺，生效的时间适用本法第一百三十七条的规定。承诺不需要通知的，根据交易习惯或者要约的要求作出承诺的行为时生效。
