释义	1、原告撤诉后，等于离婚案件的审理属于未诉状态。如果第二次起诉离婚，仍然视为第一次起诉离婚。如果法院并没有判离，那么原告还要再进行第三次起诉；2、原告撤诉后，如果没有新情况、新理由，必须要过六个月才能再次起诉。如有新情况、新理由可不受六个月限制。法律依据《中华人民共和国民事诉讼法》第一百二十七条
