我国法律规定服刑人员能结婚吗 |

服刑人员能结婚。法律上规定，我国实行婚姻自由制度，只要当事人主体合格，且自愿结婚的，就可以到任何一方常住户口所在地的婚姻登记机关办理结婚登记。
法律分析
服刑期间结婚是可以的。
我国已颁布的法律及司法解释都没有明确规定服刑期间的犯人是否可以登记结婚。
根据民法的一项重要基本原则，“法不禁止则自由”，即只要法律没有对某项行为作出禁止性规定，都可以实施该行为。因此，犯人在服刑期间是应当允许登记结婚的。
但是，服刑期间的犯人理论上是可以结婚，但是实际操作非常的困难。
而缓刑、假释之人，因为没有丧失人身自由，可以亲自到婚姻登记机关进行结婚登记，只要符合结婚条件，应当允许登记结婚。

法律依据 《婚姻登记条例》第四条，内地居民结婚，男女双方应当共同到一方当事人常住户口所在地的婚姻登记机关办理结婚登记。 中国公民同外国人在中国内地结婚的，内地居民同香港居民、澳门居民、台湾居民、华侨在中国内地结婚的，男女双方应当共同到内地居民常住户口所在地的婚姻登记机关办理结婚登记。
