释义	法律分析: 被批捕的意思就是经过法院或检察院批准同意,逮捕犯人。从法律意义上讲,公安部门不能直接逮捕犯人,逮捕犯人需要经检察院或人民法院的批准。法律依据: 《中华人民共和国刑事诉讼法》第三条对刑事案件的侦查、拘留、执行逮捕、预审，由公安机关负责。检察、批准逮捕、检察机关直接受理的案件的侦查、提起公诉，由人民检察院负责。审判由人民法院负责。除法律特别规定的以外，其他任何机关、团体和个人都无权行使这些权力。
