释义	一般农村夫妻离婚后，土地使用权归土地承包方所有，但是也有一些特殊情况。比如双方离婚后，女方仍在本村居住的，且没有拿到新的承包土地，那么原来的土地使用权其依法享有。法律依据：《中华人民共和国民法典》第一千零八十七条离婚时,夫妻的共同财产由双方协议处理;协议不成时，由人民法院根据财产的具体情况，照顾子女和女方权益的原则判决。夫或妻在家庭土地承包经营中享有的权益等，应当依法予以保护。
