问题	没收财产要不要没收夫妻共同财产
释义	夫妻共同财产不属于没收财产的范围，但夫妻共同财产中属于犯罪分子的部分属于财产没收的范围。没收财产的仅没收犯罪分子个人所有财产的一部或者全部，不会没收犯罪分子家属的财产。法律依据《刑法》第五十九条，没收财产是没收犯罪分子个人所有财产的一部或者全部。没收全部财产的，应当对犯罪分子个人及其扶养的家属保留必需的生活费用。在判处没收财产的时候，不得没收属于犯罪分子家属所有或者应有的财产。
