释义	法律分析: 商标被撤销之后如果有相同或者近似的商标注册申请，并且是在注册商标被撤销之日起一年内的，商标局对其相同或者相似的商标不予核准。商标被宣告无效或者注销的，遇到这种相同或相似商标也不予核准。《中华人民共和国商标法》第五十条注册商标被撤销、被宣告无效或者期满不再续展的，自撤销、宣告无效或者注销之日起一年内，商标局对与该商标相同或者近似的商标注册申请，不予核准。
