一、不负刑事责任民事赔偿怎么处理
当事人不负刑事责任的，民事赔偿由当事人协商解决，协商不成的可以申请调解、仲裁或者提起诉讼。
《中华人民共和国刑法》第三十六条【赔偿经济损失与民事优先原则】
由于犯罪行为而使被害人遭受经济损失的，对犯罪分子除依法给予刑事处罚外，并应根据情况判处赔偿经济损失。承担民事赔偿责任的犯罪分子，同时被判处罚金，其财产不足以全部支付的，或者被判处没收财产的，应当先承担对被害人的民事赔偿责任。
二、刑事附带民事诉讼的规定是怎么样的
1、因人身权利受到犯罪侵犯而遭受物质损失或者财物被犯罪分子毁坏而遭受物质损失的，可以提起附带民事诉讼。
对于被害人因犯罪行为遭受精神损失而提起附带民事诉讼的，人民法院不予受理。
2、被害人因犯罪行为遭受的物质损失，是指被害人因犯罪行为已经遭受的实际损失和必然遭受的损失。
3、人民法院审理附带民事诉讼案件，依法判决后，查明被告人确实没有财产可供执行的，应当裁定中止或者终结执行。
4、被告人已经赔偿被害人物质损失的，人民法院可以作为量刑情节予以考虑。
5、犯罪分子非法占有、处置被害人财产而使其遭受物质损失的，人民法院应当依法予以追缴或者责令退赔。被追缴、退赔的情况，人民法院可以作为量刑情节予以考虑。
经过追缴或者退赔仍不能弥补损失，被害人向人民法院民事审判庭另行提起民事诉讼的，人民法院可以受理。
