释义	法律分析: 犯罪预备亦称预备犯。是为犯罪准备工具、制造条件的行为。故意犯罪中介于犯罪决意与着手实行犯罪之间的一个阶段。特征：(1)行为人已经开始实施犯罪的预备行为。 (2)行为人尚未着手犯罪的实行行为。 (3)行为人的意图和目的，是为了顺利着手实施和完成犯罪。 (4)犯罪在实行行为尚未着手时停止下来，是由于行为人意志以外的原因所致。法律依据: 《中华人民共和国刑法》第二十二条为了犯罪，准备工具、制造条件的，是犯罪预备。对于预备犯，可以比照既遂犯从轻、减轻处罚或者免除处罚。
