释义	法律分析：在我国刑法中只有诬告陷害罪，并没有诬陷罪，还有就是诽谤罪。根据我国刑法第二百四十三条规定：诬告陷害罪，是指捏造事实诬告陷害他人，意图使他人受刑事追究，情节严重的行为。本罪在客观上表现为捏造他人犯罪的事实，向国家机关或有关单位告发，或者采取其他方法足以引起司法机关的追究活动。法律依据：《中华人民共和国刑法》第二百四十三条第二款不是有意诬陷，而是错告，或者检举失实的，不适用前两款的规定。国家机关工作人员犯本罪的，从重处罚。
