释义	非法捕捞水产品罪的构成要件如下：1、侵犯的客体是国家保护水产资源的管理制度；2、在客观方面表现为违反保护水产资源法规，在禁渔区、禁渔期或者使用禁用的工具林、方法捕捞水产品的行为；3、主体为一般主体，即蔽稿枝凡是达到刑事责任年龄具有刑事责任能力的人，均可构成本罪；4、在主观方面表现为故意。法律依据：《中华人民共和国刑法》第三百四十条违反保护水产资源法规，在禁渔区、禁渔期或者使用禁用的工具、方法敬雹捕捞水产品，情节严重的，处宏敏三年以下有期徒刑、拘役、管制或者罚金。
