释义	虚假离婚当事人均未与第三人结婚的，其离婚可以被宣告无效。办理虚假离婚登记，骗取离婚证的，经当事人申请，应当由办理离婚登记的婚姻登记机关宣布其离婚无效，并收回离婚证。【法律依据】《婚姻登记条例》第十三条，婚姻登记机关应当对离婚登记当事人出具的证件、证明材料进行审查并询问相关情况。对当事人确属自愿离婚，并已对子女抚养、财产、债务等问题达成一致处理意见的，应当当场予以登记，发给离婚证。《民法典》第一千零八十条，完成离婚登记，或者离婚判决书、调解书生效，即解除婚姻关系。
