释义	造成轻微伤，双方进行调解，一方要求金额较高的，不属于敲诈。一方面，虽然要求金额较高，但是其对赔偿有其法律依据；另一方面，调解遵循自愿原则，另一方不同意的情况下，可以拒绝调解，因此不属于敲诈。法律依据：《中华人民共和国刑法》第二百七十四条敲诈勒索公私财物，数额较大或者多次敲诈勒索的，处三年以下有期徒刑、拘役或者管制，并处或者单处罚金额巨大或者有其他严重情节的，处三年以上十年以下有期徒刑，并处罚金额特别巨大或者有其他特别严重情节的，处十年以上有期徒刑，并处罚金。
