释义	法律分析：如果司法鉴定造假是否判刑，要根据情节的严重程度进行处罚的，如果不严重的话就是行政处罚，视情节而定，轻则受行政处罚；重则受刑事处罚。鉴定人故意作虚假鉴定的，由省人民政府司法行政部门，取消其鉴定资格；构成犯罪的，依法追究刑事责任。法律依据：《司法鉴定通则》第五条司法鉴定实行鉴定人负责制度。司法鉴定人应当依法独立、客观、公正地进行鉴定；并对自己作出的鉴定意见负责。司法鉴定人不得违反规定，会见诉讼当事人及其委托的人。
