小产权房能不能确权?

法律分析：
小产权房不能确权。小产权房的性质以下两种：
1、是在集体建设用地上建成的，即“宅基地”上建成的房子，只属于该农村的集体所有者，外村农民不能购买；
2、在集体企业用地或者占用耕地违法建设的房子。
国家发产权证的叫“大产权房”，国家不发产权证的叫“小产权房”。大、小产权房的争议不在房屋所有权，而是土地使用权。

《中华人民共和国土地管理法》
第一百三十六条 小产权房不能向非本集体成员的第三人转让或出售，即购买后不能合法转让过户。其同时对房屋的保值和升值也有一定影响。
