释义	法律分析：离婚后，一方要求变更子女抚养关系的，或者子女长到有识别能力时，主动提出与另一方一起生活时，应另行起诉。离婚后，变更子女抚养关系的请求，不涉及原离婚案件，不是对原离婚案件子女抚养问题的判决、调解协议的纠正，而是出现了处理原离婚案件当时不存在的子女抚养方面的新情况，所以，应当作新的案件另行起诉。法律依据：《最高人民法院关于适用婚姻家庭编的解释（一）》第五十五条，离婚后，父母一方要求变更子女抚养关系的，或者子女要求增加抚养费的，应当另行提起诉讼。
