巨额财产来源不明罪，是指国家工作人员的财产或者支出明显超过合法收入，差额巨大，其不能说明财产来源合法的行为。其侵犯客体属于复杂客体，即国家工作人员的廉洁以及公私财物所有权;本罪的客观方面指的是，国家工作人员的财产或支出明显超过了其合法收入，差额巨大，其又不能说明来源是合法的;本罪主体属于特殊主体，即国家工作人员，若是非国家工作人员，是不能够成为本罪的主体的;本罪主观上是故意，即行为人明知财产来源是不合法的，却又进行故意占有，于案发后又故意拒不说明该财产的真正来源方向，或是故意编造财产的来源是合法的。

《中华人民共和国刑法》
第三百九十五条 第一款 国家工作人员的财产或者支出明显超过合法收入，差额巨大的，可以责令说明来源。本人不能说明其来源是合法的，差额部分以非法所得论，处五年以下有期徒刑或者拘役，财产的差额部分予以追缴。
第九十三条 本法所称国家工作人员，是指国家机关中从事公务的人员。国有公司、企业、事业单位、人民团体中从事公务的人员和国家机关、国有公司、企业、事业单位委派到非国有公司、企业、事业单位、社会团体从事公务的人员，以及其他依照法律从事公务的人员，以国家工作人员论。
