释义	合同保证金又称为履约保证金，是合同双方确保履约的一种财力担保。履约保证金金额有些地方是中标合同价的5％以内，有些地方是中标合同价的10％以内，施工履约保证金金额有些地方规定为中标价的20％。另外，有些采购机构对询价采购方式规定，经采购人特别要求，可以在询价标段中明确成交供应商在签订合同时，须向采购人提交不高于成交额10%的履约保证金。采购人未作特别要求的，一般将询价保证金自动转为履约保证金，额度为成交额的1%，如不足可以要求补缴。法律依据政府采购非招标采购方式管理办法第二十条
