释义	法律分析：小产权的土地使用证不归个人，是归集体所有。小产权房不论是哪一年的，都会有土地证，但是土地证的权属是集体的，虽然有可能在某个人的手里；但是法定不归某个人，也不能分给每一户去登记一个单独的土地证，只能是集体所有，也会归属集体保管，权属归属集体，所有权也归属集体所有。因为小产权房的土地使用证是归集体所有，个人也不可以随意的进行买卖和转让，在购买小产权房时避免自己的财产受到任何的损失。法律依据：《城市房地产管理法》第六十条，国家实行土地使用权和房屋所有权登记发证制度。
