释义	法律分析: 劳动合同可以代签，但必须作出明确意思表示且不做否认。民事主体可以通过代理人实施民事法律行为，代理人不超过代理权限所做的行为均是对被代理人产生相应的法律效力的。用人单位与劳动者协商一致签订劳动合同，自用人单位与劳动者在劳动合同文本上签字或者盖章生效。用人单位自用工之日起即与劳动者建立劳动关系，应当在一个月内签订书面劳动合同，非全日制用工可以用口头形式签订。《中华人民共和国劳动合同法》第七条用人单位自用工之日起即与劳动者建立劳动关系。用人单位应当建立职工名册备查。
