发生劳动争议后有哪些维权途径

法律主观：

    在劳动争议中当事人需保留下列维权证据：
    1、与用人单位存在劳动关系的证据，比如劳动合同；
    2、可以证明自己主张的证据，比如证明自己加班了的证据；
    3、证明用人单位存在违法行为的其他证明等。

法律客观：

《中华人民共和国劳动合同法》第三十条用人单位应当按照劳动合同约定和国家规定，向劳动者及时足额支付劳动报酬。用人单位拖欠或者未足额支付劳动报酬的，劳动者可以依法向当地人民法院申请支付令，人民法院应当依法发出支付令。
