释义	法律分析: 已设立土地抵押的项目，不能办理商品房预售许可。法律依据: 《城市商品房预售管理办法》第五条商品房预售应当符合下列条件：（一）已交付全部土地使用权出让金，取得土地使用权证书；（二）持有建设工程规划许可证和施工许可证；（三）按提供预售的商品房计算，投入开发建设的资金达到工程建设总投资的25%以上，并已经确定施工进度和竣工交付日期。由上诉条件，将土地抵押，即不可获得土地使用权证书，因此，已设立土地抵押的项目，不能办理商品房预售许可。
