释义	法律分析: 刑法对于重婚罪的认定分为两种情形。第一种是明明已有配偶又跟他人登记结婚的人，或者明明已有配偶仍然与他人以夫妻的名义共同生活，其违反了一夫一妻原则；第二种是明知对方有配偶仍然与之登记结婚或者明知对方有配偶仍然以夫妻名义共同生活，“明知”包括事先知道也包括事后知道仍然继续保持此种关系的情形。对于重婚的认定，具体还是要看双方是否构成另外的夫妻关系。法律依据: 《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
