离职扣提成合法吗 |

违法。劳动者在公司辞职，而且按公司规定办理离职手续和工作交接，但公司克扣工资，那么违反劳动合同法规定，劳动者可以反映到劳动局解决，申请赔偿。
离职，是指职工离开原职务和原工作单位的劳动法律制度。有两种情况，一种是离职休养，离职入校学习进修，停薪留职，这种离职不终止劳动法律关系；另一种是职工本人要求辞职被单位批准离职，被单位辞退离职、自动离职等，这种离职终止劳动法律关系。离职职工根据不同情况享受不同的待遇。
相关法律规定，用人单位有下列情形之一的，由劳动行政部门责令限期支付劳动报酬、加班费或者经济补偿;劳动报酬低于当地最低工资标准的，应当支付其差额部分;逾期不支付的，责令用人单位按应付金额百分之五十以上百分之一百以下的标准向劳动者加付赔偿金：
1、未按照劳动合同的约定或者国家规定及时足额支付劳动者劳动报酬的;
2、低于当地最低工资标准支付劳动者工资的;
3、安排加班不支付加班费的;
4、解除或者终止劳动合同，未依照本法规定向劳动者支付经济补偿的。

第五十条
工资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的工资。企业必须在员工离职后十五日内办理解除劳动关系证明书及社保转移手续。未办理的，造成员工损失的，企业承担法律责任。
第九十一条
用人单位有下列侵害劳动者合法权益情形之一的，由劳动行政部门责令支付劳动者的工资报酬、经济补偿，并可以责令支付赔偿金：
(一)克扣或者无故拖欠劳动者工资的;
(二)拒不支付劳动者延长工作时间工资报酬的;
(三)低于当地最低工资标准支付劳动者工资的;
(四)解除劳动合同后，未依照本法规定给予劳动者经济补偿的。
