释义	法律分析: 对犯罪嫌疑人应当是先批捕，但是如果是公安机关在立案侦查阶段没有对犯罪嫌疑人进行批捕，但是人民法院受理人民检察院提起的公诉后；认定犯罪嫌疑人存在社会危险性的，就属于是先起诉，后批捕，多数情况下是在案件的立案侦查阶段就对犯罪嫌疑人进行逮捕的。法律依据: 《中华人民共和国刑事诉讼法》第八十七条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据；一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
