农村集市卖烟丝，擅自销售烟丝的，属于违法行为 根据法律规定，卷烟、雪茄烟、烟丝、复烤烟叶统称烟草制品，都属于烟草专卖品范畴。国家对烟草专卖品的生产、销售、进出口依法实行专卖管理，未经许可不得擅自销售。
法律依据：
《中华人民共和国烟草专卖法》 第十九条 卷烟、雪茄烟和有包装的烟丝必须申请商标注册，未经核准注册的，不得生产、销售。
