刑讯逼供罪是如何构成的?

法律分析：
刑讯逼供罪是由下列要件构成的：本罪侵犯的客体是公民的人身权利和国家司法机关的正常司法活动；在客观上表现为对犯罪嫌疑人、被告人使用肉刑或者变相肉刑，逼取口供的行为；犯罪主体是司法工作人员；在主观上只能是故意，并且具有逼取口供的目的。
法律依据：
《刑法》第二百四十七条
司法工作人员对犯罪嫌疑人、被告人实行刑讯逼供或者使用暴力逼取证人证言的，处三年以下有期徒刑或者拘役。致人伤残、死亡的，依照本法第二百三十四条、第二百三十二条的规定定罪从重处罚。
