玩忽职守罪的构成要件如下：
1、犯罪主体必须是国家工作人员；
2、主观上出于行为人职务上的过失，如疏忽大意、过于自信、擅离职守等；
3、犯罪客体是国家机关的正常活动；
4、客观上表现为因行为人不履行或不正确履行应负的职责造成重大损失。
玩忽职守罪的司法解释是，犯本罪的，一般会被法院判处三年以下的有期徒据刑，或者拘役。如果情节特别严重的，那么罪犯会被法院判处三年以上七年以下的有期徒刑。

《中华人民共和国刑法》
第四百零八条 【食品监管渎职罪】负有食品药品安全监督管理职责的国家机关工作人员，滥用职权或者玩忽职守，有下列情形之一，造成严重后果或者有其他严重情节的，处五年以下有期徒刑或者拘役；造成特别严重后果或者有其他特别严重情节的，处五年以上十年以下有期徒刑：
（一）瞒报、谎报食品安全事故、药品安全事件的；
（二）对发现的严重食品药品安全违法行为未按规定查处的；
（三）在药品和特殊食品审批审评过程中，对不符合条件的申请准予许可的；
（四）依法应当移交司法机关追究刑事责任不移交的；
（五）有其他滥用职权或者玩忽职守行为的 。
徇私舞弊犯前款罪的，从重处罚。
第四百零九条 【传染病防治失职罪】从事传染病防治的政府卫生行政部门的工作人员严重不负责任，导致传染病传播或者流行，情节严重的，处三年以下有期徒刑或者拘役。
