释义	法律分析: 女职工怀孕流产的，其所在单位应根据医务部门的证明，按下列规定给予产假：三个月以下的，产假15天；三个月以上(含三个月)至四个月的，产假30天；四个月以上(含四个月)至七个月的，产假四十二天；七个月以上(含七个月)的，按正常产假处理。法律依据: 《女职工劳动保护规定》第八条女职工产假为90天，其中产前休假15天。难产的，增加产假15天。多胞胎生育的，每多生育一个婴儿，增加产假15天。女职工怀孕流产的，其所在单位应当根据医务部门的证明，给予一定时间的产假。
