问题	对公房有“部分产权”，离婚时如何分割？
释义	分得房屋“部分产权”的一方，一般应按所得房屋产权的比例，依照离婚时当地政府有关部门公布的同类住房标准价，给予对方一半价值的补偿。如果双方都争房子所有权，对于“部分产权”部分，可竞价解决。谁出价高房子判归谁。应当指出的是，这是九十年代的司法解释的规定，根据最新的《司法解释（二）》第21条的规定：离婚时，双方对尚未取得所有权或者尚未完全取得所有权的房屋有争议且协商不了的，人民法院不宜判决房屋的所有权归属，应当根据实际情况判决由当事人使用。待取得房屋产权证后，再有任何一方另行向法院起诉。
